D.LGS. 231/01 – MODEL OF ORGANIZATION, MANAGEMENT AND CONTROL

Scientific rationale

Legislative Decree 231/2001 introduced in the Italian order the administrative responsibility of the entities for certain crimes committed in their interest or to their advantage by those who hold apical functions or by those who are subject to their direction. For a health facility like an IRCCS, knowing this discipline is essential. Each operator contributes to the smooth functioning of the crime prevention system adopted by the body.
The course first presents the general principles of the decree: the assumptions of responsibility, the preconditions of crimes, the "organization fault" and the system of sanctions. Then illustrates the Model of organization, management and control adopted by the Mondino Foundation. The organisational system, the Supervisory Organism, whistleblowing, the disciplinary system, the Code of Ethics, training and updating are dealt with. The special part analyses sensitive areas at the risk of crime, with practical cases on crimes against the Public Administration.
The aim is to give participants the tools to recognize the risk situations in their activity and to correctly apply the protocols and procedures of the Model.
